Terms of Service

Please read these Terms of Service (hereinafter: "Terms") carefully before using the cFlash application and website (hereinafter: "Service"). By using the Service or registering, you accept and acknowledge these Terms as binding upon you.

1. The Service

cFlash is a multilingual (Hungarian, English, German) cryptocurrency information platform that collects, processes, and summarizes relevant news and data from the crypto market. The Service strives for fast and efficient content delivery, however, data processing time also depends on external sources.

2. Eligibility

Legal capacity under applicable law is required to use the Service. By registering, you represent and warrant that:

• You have the legal capacity to enter into contracts
• The information you provide is true and accurate
• You have read and accept these Terms
• You have read and accept the Privacy Policy

3. User Account

3.1 Registration

Registration is required to use the full features of the Service. You must provide true and accurate information during registration. One natural person may create only one user account. The account is personal and non-transferable.

3.2 Account Security

You are fully responsible for:

• Keeping your password confidential and secure
• All activities conducted with your account, regardless of whether performed by you or another person
• Immediately reporting unauthorized access at support@cflash.app

The Service Provider is not liable for damages arising from sharing, loss, or unauthorized use of passwords.

3.3 Account Deletion

You may request deletion of your account at any time through the app settings or at support@cflash.app. After deletion, your personal data will be handled according to the Privacy Policy.

4. Free Access

Basic features of cFlash can be used by all registered users free of charge and without time limitation. Free access allows you to explore the platform and try out basic features.

Certain features and content are available to free users on a limited basis. A Premium subscription is required to unlock these limitations. The exact scope and extent of limitations can be viewed in the app, and the Service Provider is entitled to modify them from time to time.

5. Premium Subscription

With a Premium subscription, you gain access to the full functionality of the Service, including unlimited content access, real-time notifications, and full personalization options.

Available subscription packages, their prices, and content can be viewed in the app. The Service Provider reserves the right to modify prices and packages, however, the terms of existing subscriptions remain unchanged until the end of the subscription period.

6. Payment Terms

6.1 App Store and Google Play Purchase

For purchases made through the Apple App Store or Google Play Store:

• Payment transactions are handled by Apple Inc. or Google LLC
• Subscriptions automatically renew at the end of the period at the current subscription price
• Automatic renewal can be cancelled at any time at least 24 hours before expiration
• Purchases are subject to Apple's or Google's general terms and refund policies

Apple Inc. and Google LLC are third-party beneficiaries of these Terms, but are not responsible for the operation, content, or damages arising from the Service.

6.2 Cryptocurrency Payment

The Service allows payment for subscriptions in cryptocurrency through a third-party payment provider. The following terms apply to cryptocurrency payments:

• Cryptocurrency transactions are by nature irreversible and non-refundable
• The subscription is activated after payment confirmation
• Cryptocurrency purchases do not include automatic renewal
• Network fees incurred during the transaction are borne by the user

6.3 Refunds

Refunds for App Store or Google Play purchases are governed by the respective platform's refund policy. You must submit refund requests directly to Apple or Google.

Cryptocurrency purchases are non-refundable due to the irreversible nature of blockchain transactions.

7. Referral Program

The cFlash referral program allows users to receive rewards for successful referrals.

7.1 How the Program Works

• Each user has a unique referral code
• A successful referral is when someone registers with your code and becomes an active Premium subscriber
• After three (3) successful referrals, you receive Lifetime Premium access, valid for the duration of the Service's existence
• Rewards are automatically credited by the system

7.2 Prohibition of Abuse

Strictly prohibited:

• Creating fictitious or fake accounts to obtain rewards
• Self-referral using multiple accounts
• Any manipulation or circumvention of the referral system

Abuse will result in immediate account suspension, revocation of rewards, and exclusion from the program.

7.3 Program Modification

The Service Provider reserves the right to unilaterally modify the rules, terms, and rewards of the referral program or to discontinue the program. Modifications do not affect rewards lawfully obtained.

8. External Services Integration

The Service provides the option to optionally connect with external, third-party operated services (e.g., messaging platforms, notification services). Use of these integrations:

• Is completely voluntary and optional
• Can be terminated at any time in the app settings
• Is also subject to the external provider's own terms of use and privacy policy
• May be available only to Premium subscribers in certain cases

The Service relies on external data sources and news providers to deliver content. The Service Provider is not responsible for the operation, availability, accuracy, or damages caused by external services.

9. Prohibited Activities

When using the Service, you agree to refrain from the following activities:

• Unauthorized copying, distribution, publication, or commercial use of content
• Compromising the security of the Service, servers, or network
• Using automated queries, bots, scrapers, crawlers, or similar tools
• Automated data collection or mass querying of any part of the Service
• Reverse engineering, modifying, decompiling, or manipulating the application
• Disturbing, harassing other users, or unauthorized collection of their personal data
• Using the Service for illegal purposes or in ways that violate third-party rights
• Spreading false, misleading, or deceptive information
• Distributing malicious code, viruses, or other malware
• Intentionally damaging the reputation or business interests of the Service Provider

10. Limitation of Liability

10.1 Content and Data

Content displayed in the Service comes from various external sources. The Service Provider does not guarantee and expressly disclaims liability for:

• The accuracy, completeness, timeliness, or reliability of content
• The credibility of sources or the truthfulness of information
• Consequences of decisions made based on the content
• Damages arising from any interpretation of the content
• The accuracy, completeness, or timeliness of price data, market data, or statistics

10.2 Service Availability

The Service Provider strives for continuous and uninterrupted operation, but does not guarantee:

• Uninterrupted, continuous availability of the Service
• Immediate or guaranteed delivery of notifications
• Error-free operation or data integrity

The Service Provider is entitled to temporarily suspend the Service for maintenance, development, or other reasons.

10.3 Exclusion of Damages

To the fullest extent permitted by law, the Service Provider disclaims liability for any direct, indirect, incidental, special, punitive, or consequential damages, including but not limited to:

• Investment or financial losses
• Lost profits or business opportunities
• Data loss or corruption
• Damage to reputation
• Costs of procuring substitute services

The Service Provider's liability – where it cannot be excluded by law – is in all cases limited to the amount of fees paid by you during the relevant subscription period.

11. Intellectual Property

The Service and all its elements – including but not limited to design, source code, software, databases, logos, trademarks, content, and summaries – are protected by copyright and other intellectual property rights.

• Use is permitted only for personal, non-commercial purposes
• Copying, distributing, modifying, or commercial use of content without the prior written permission of the Service Provider is prohibited
• The cFlash name, logo, and brand elements are trademark protected

12. Application Usage License

By accepting these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to download and use the application solely for personal, non-commercial purposes, subject to compliance with these Terms.

The license does not entitle you to:

• Modify, adapt, or create derivative works of the application
• Distribute, rent, lease, or commercially exploit the application
• Access the application's source code or reverse engineer it
• Transfer the license to third parties

The Service Provider may revoke the license at any time in case of violation of these Terms.

13. Account Suspension and Termination

The Service Provider reserves the right to suspend or permanently terminate your access without prior notice and with immediate effect if:

• You violate these Terms or the Privacy Policy
• You abuse the Service or its features
• You engage in or participate in illegal activities
• You compromise the security of the Service or other users
• You provide false information or engage in deceptive conduct

In case of suspension or termination, no pro-rated refund of subscription fees is due, and the Service Provider is not obligated to pay compensation.

14. Service Modification

The Service Provider reserves the right to unilaterally modify, expand, or limit the features, content, appearance, and operation of the Service. The Service Provider is also entitled to discontinue certain features, provided users are notified in advance.

15. Force Majeure

The Service Provider is not liable for service outages, delays, or performance obstacles resulting from force majeure events. Force majeure events include, but are not limited to:

• Natural disasters, war, terrorist attacks, pandemics
• Strikes, work stoppages, civil unrest
• Internet service outages, telecommunications failures
• Server failures, hardware failures, cyberattacks
• Governmental or judicial actions, legislative changes
• Power outages, energy supply disruptions

In case of a force majeure event, the Service Provider's obligations are suspended for the duration of the event.

16. Sanctions Compliance

The Service may not be used in countries, regions, or by persons subject to economic or trade sanctions imposed by the European Union, the United States (OFAC), the United Kingdom, the UN, or other competent authorities.

By registering and using the Service, you represent and warrant that:

• You are not listed on any sanctions list
• You are not using the Service from a country or region subject to trade embargo or sanctions
• You are not using the Service for the benefit of sanctioned persons or organizations

The Service Provider reserves the right to refuse service and suspend accounts if there is suspicion of sanctions compliance violation.

17. Terms Modification

The Service Provider reserves the right to unilaterally modify these Terms. Users will be notified of significant changes through in-app notifications and/or email.

Modified Terms take effect on the date of publication. Continued use after publication constitutes acceptance of the modified Terms. If you do not accept the modifications, you are entitled to delete your account.

18. Governing Law and Dispute Resolution

These Terms and any legal relationships arising therefrom are governed by Hungarian law. The parties undertake to resolve any disputes primarily through peaceful means and negotiation.

If peaceful resolution is unsuccessful, the parties submit to the jurisdiction of the Hungarian court having jurisdiction based on the Service Provider's registered office.

In case of consumer disputes, you are entitled to turn to the arbitration board having jurisdiction based on your place of residence.

19. Other Provisions

19.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, it does not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely reflects the original intent of the parties.

19.2 Entire Agreement

These Terms and the Privacy Policy together constitute the entire agreement between the parties regarding the use of the Service and supersede all prior agreements or communications.

19.3 Waiver

Failure by the Service Provider to exercise any right or remedy does not constitute a waiver of that right or remedy.
